General Information
Services
We understand mains water is connected, however, prospective purchasers must satisfy themselves as to the availability and suitability of these services.
Rights of Way, Wayleaves and Easements
The property is sold subject to and with the benefit of all rights of way, wayleaves and easements in existence at the time of the sale.
It is understood there is an unwritten right of way for the benefit of the neighbouring property to gain access to their field. It is assumed this is for agricultural and equestrian purposes only.
There are two points of access being Moisty Lane and an unwritten right of way which is understood to be for agricultural use only via a track off Bag Lane which is hatched brown, on the plan.
Sporting, Timber and Mineral Rights
It is understood that mineral rights are included within the freehold sale.
Tenure & Possession
The freehold of the property is being offered subject to an occupation under the Agricultural Holdings Act 1986, which we believe commenced on the 1st May 1985. There is a memorandum of tenancy which is dated 1998 confirming the first rent payment as at the 1st May.
We therefore believe that the occupation does not convey the provision of succession rights, however purchasers should not rely upon this and obtain their own advice. A copy of the memorandum and further information is available from the selling agents.
Overage Clause
The property is subject to an overage clause for a period of 30 years, at 25% of the uplift in value of the land on the implementation of or the disposal of the property with planning permission for any non-agricultural or non- equestrian development.
