2. All the lots are freehold but most lots are subject to leases or licences. Please refer to the individual lot descriptions. Full details are available in the Data Room.
3. All lots are sold subject to all rights of support, public and private rights of way, water, light, drainage and other easements, quasi easements and wayleaves, all or any other like rights, whether mentioned or not.
4. There will be no apportionment of rents paid in advance to the vendor who will retain all rental payments made prior to the completion date.
5. All existing uses are permitted (agriculture, equestrian and forestry as appropriate to the individual lots). A development clawback will attach to all lots whereby 20% of the uplift in value as a result of the grant of planning permission for alternative uses within a period of 25 years from the date of completion will apply.

Covenants under the lease to Peel Wind Farms (Blue Sky Forest) Ltd until 17 June 2045, relevant to Lots 4 to 8 inclusive, include the following:
a) To permit the Tenant to enter onto the Landlord's property or on nearby land owned or controlled by the Landlord on reasonable notice to trim or lop any tree or hedge on which may have grown to a height which in the reasonable opinion of the tenant interferes with obstructs or affects the free flow of wind and sit to the Turbines on the Site or the wind speed or wind direction over the Site.
b) Not to interfere with or damage (or knowingly to permit to be interfered with or damaged) the Turbines.
c) That the distance between any building or other structure erected on the Landlord's Property or on nearby property owned or controlled by the Landlord and the Turbine nearest to it will exceed that part of the height of the relevant building or other structure which is above the surface level of the land upon which such Turbine is constructed, multiplied by 10.
d) Not to do or permit to be done anything in or upon the Landlord's Property or on nearby property owned or controlled by the Landlord which might in the reasonable opinion of the Tenant interfere with obstruct or affect the free flow of wind and air to the Turbines on the Site or the wind speed or wind direction over the Site.
e) To pay a fair and reasonable contribution (according to area) of the cost of maintaining the Access Roads.
f) Not to breach or permit to be breached or cause the Tenant to be in breach of the Necessary Consents
g) Not to do or permit to be done anything in or upon the Landlord's Property which could damage the Supply Cables or in any way cause a breach of any statute, order, regulation or byelaw for the time being in force relating to the Supply cables and to take reasonable care not to disturb or uncover any underground Supply Cables.
h) Not to erect nor, other than under statutory compulsion, to allow any person to erect any building or dwelling of any kind on the Landlord's Property or (save for the Leisure Complex) within 1,000 metres of any Turbines.
i) Not to occupy nor, other than under statutory compulsion, to allow any person to occupy any building or dwelling of any kind on the Landlord's Property or (save for the Leisure Complex) within 1,000 metres of any Turbines.
j) Not to plant or allow any person to plant any trees to grow on the Landlord's Property or within 1,000 meters of any of the Turbines save for the Leisure Complex or as required in terms of the Mining Restoration Plan or Section 106 Agreement.
k) Not to grant any lease, licence or option of any other rights over the Landlord's Property for a use similar to the Development (or otherwise allow anyone other than the Tenant to promote any use similar to the Development on the Landlord's Property) and to include in any conveyance, transfer, lease, licence, contract for sale or option entered into in respect of the Landlord's Property a covenant on the part of the purchaser, lessee or grantee not to use any part of the landlord's Property (other than the Property) for a use similar to the Development.
l) Not to sell, grant a lease of the reversion or otherwise dispose of the Landlord's Property save to someone who (i) acquires the freehold of the Landlord's Property subject to (and with the benefit of) this Lease or (ii) acquires a lease of the area shown hatched mauve on the Plan subject to the restrictions contained in the Lease.
m) Not to grant or create any legal or equitable interest in the Landlord's Property which would adversely affect the rights granted in the Lease.
n) Not to grant or create any rights in favour of any person to acquire any legal or equitable interest in the Landlord's Property which would adversely affect the rights granted in this lease.
Schedule 1 of the Lease gives rights for the Tenant to undertake works over the Landlord's retained Property including the laying, installation and maintenance of access tracks and roads; service media; ditches, culverts etc; signage; security systems etc.
