Location & Access - Lots 1, 2 & 3 are accessed off of Farlesthorpe Road, Farlesthorpe, and can be identified clearly by the For Sale boards which are located on the north and south of the public highway. The vendors shall allow a temporary access to Lot 1 over their retained land, however, the purchaser of Lot 1 shall require to create a new access within 6 months of completion.

Lot 4 is accessed off of Bracken Lane, Hogsthorpe, via a Right of Way leading from the northern end of Bracken Lane, as shown dotted blue on the attached plan.

Lot 5 is accessed off of the main A52, where the land abuts the highway, with the access being identified by a For Sale board in the gateway.

Tenure & Possession - The Freehold interest in the land is being sold with full Vacant Possession upon completion, however, completion of sale cannot take place on any of the 5 Lots until after the 31st December 2022 due to the Mid-Tier Stewardship Scheme.

Basic Payment Scheme, & Nvz - All of the land is registered with the Rural Payments Agency and the Basic Payment Scheme Entitlements are excluded from the sale.

The Vendors reserve the right to retain the 2022 Basic Payment Scheme claim.

A proportion of Lot 1 lies within a surface water Nitrogen Vulnerable Zone as a designated by the Environment Agency.

Stewardship Schemes - A large proportion of the land is currently entered into a Mid-Tier Stewardship Scheme (AB8, AB15, GS8 & GS9) which is to conclude on 31st December 2022, and therefore the land is under obligation until this date and any subsequent sale cannot conclude until this date has passed.

Cross Compliance - The vendor will be responsible for cross compliance up to the date of completion.
The purchaser will take over the cross compliance obligations upon completion or early entry and will therefore indemnify the vendor for any breach of compliance which results in a penalty or reduction of the vendors payments from the Basic Payment Scheme until the end of the current calendar year.

Services - Field No. 3064, which falls within Lot 3 has the benefit of a mains water connection which services a cattle drinking trough. We are not aware that any other mains services are connected to any of the land.

Grade, Soil Type & Topography - All of the land is schedule Grade 3 by the Agricultural Land Classification of England and Wales.

Lots 1,2 & 3 are defined by the Soil Survey of England and Wales as Holderness, being Chalky Till and suitable for cereals and temporary pasture.

Lots 4 & 5 are defined by the Soil Survey of England and Wales as Wallasea 2, being Marine Alluvium and suitable for cereals, sugar beet, potatoes and some vegetables.

All of the land is level lying.

Boundaries - All of the land is clearly demarcated by boundary hedges, ditches and fencing, with the exception of the north easterly corner of Lot 1 and southerly boundary of Lot 3 which are currently open but demarcated with red topped posts. These boundaries will be fenced by the Vendors prior to completion.

The Buyers shall be deemed to have full knowledge of all boundaries and neither the seller nor the selling agent will be responsible for defining the boundaries nor their ownership.

Drainage Rates - The Drainage Rates are payable to Lindsey Marsh Drainage Board and copies of the most recent demands can be made available to prospective purchasers by contacting Willsons.

Underdrainage - All of the land was comprehensively underdrained in and around the 1970s, and electronic or paper copies of the underdrainage plans can be requested from Willsons, with the exception of a plan for a portion of the south easterly corner of Lot 1, however, the outfalls for this area can be found.

Easements, Wayleaves & Rights Of Way - Lot 4 is accessed via a Right of Way along Bracken Lane and through a gated access to the north of Ivy Cottage, as shown by the blue dotted line on the attached plan.

The southern end of Lot 3 is crossed by a public footpath.

The northern end of Lot 1 is crossed by a mains gas pipe and there is also a run of electricity poles running from east to west.

All of the land is sold subject to and with the help and benefit of all existing rights, including rights of way whether public or private, light, support, drainage, water and electricity supplies and other rights, easements, quasi-easements and all wayleaves whether referred to or not in these particulars.

Anti Money Laundering - In accordance with the most recent Anti Money Laundering legislation, the purchaser will be required to provide proof of identity and proof of funds to the selling agent once an offer has been submitted and accepted (subject to contract) prior to solicitors being instructed.
