Planning
The development site has outline planning permission granted for up to twelve dwellings, including 2 affordable units, dated 15th February 2021. Prospective buyers are advised to satisfy themselves and take advice on the contents and the terms of the Section 106 agreement.

Affordable Housing
The development site is subject to a Section 106 agreement dated 11th February 2021 between the Carlisle Diocesan Board of Finance Ltd and Allerdale Borough Council, a copy of which is available on request. This requires the provision of two affordable units on the site and provides for the provision of an ecological management scheme.

Access
Permission has been granted for a single access into the site off Church Lane.

Allerdale Borough Council require the open frontage onto Church Lane incorporating the site access to be widened to a minimum of 4.8m. Restrictive Covenants

(2) That no act deed matter or thing shall at any time be done suffered or permitted in or upon the Property or any part thereof which may be or become a nuisance annoyance or disturbance to the Minister for the time being conducting or the congregation attending divine service in the Parish Church of Thursby St Andrew or the Churchyard surrounding the same

(3) No hoarding or other erection shall at any time be erected or placed or suffered to be upon any part of the Property for the purpose of exhibiting any advertisement or notice other than such as relate to the selling or letting of the Property and no advertisement or notice other than as aforesaid shall at any time be affixed to or exhibited upon any part of the Property

(4) Not at any time hereafter call or designate the Property or permit the same to be called or designated by any name which might suggest that the same is owned or occupied by the Incumbent for the time being of the said Benefice.

(5) Not to use the Property for any trade or business without first obtaining the written approval of the Seller.

Money Laundering Obligations
As part of the new Money Laundering Regulations (The Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017) relating to property transactions the Selling Agents are obliged to carry out Customer Due Diligence checks on any Purchaser prior to a transaction being completed.
