Lot 2 - About 6.60 acres of arable land now down to grass, with prior approval to erect two agricultural buildings. Tender deadline 11th February 2022.
Situation
The land is accessed via Radmore Lane and is about one mile north-east of the village of Abbots Bromley.
Description
Lot 2 - About 6.70 acres of grassland in a single enclosure. This is accessed directly off Radmore Lane via a gateway in the north western corner of the land (there is no access at the southern end).
Permission to construct two agricultural building in the northeast corner of Lot 2 was granted by East Staffordshire Borough Council by way of prior approval (Class A) under application P/2017/00284 and P/2020/1137. Under the latter the building is to be timber clad and of approximately 32.0m x 9.1m x 4.9m (height) (about 3,133 sq ft gross external floor area). Approval was granted on 8th May 2017 and 6th November 2020 respectively; the 2017 approval has no time limit to during which the building must be constructed but the 2020 approval must be constructed within five years of the date of that approval. Both of these proposed buildings will sit in the north eastern corner of Lot 2 and close to the boundary of Moors Farm.
The lot has frontage to Ash Brook but the brook itself is excluded from the sale.
Note: The grants of permission for the above mentioned two buildings are by way of prior approvals under the General Permitted Development Order. To be able to satisfy the requirements of the order and therefore be able to erect these buildings the order requires that they form part of an agricultural unit of at least five hectares (this does not need to be formed by a single property). To buy lot 2 only and still be able to erect these buildings the purchaser would need to farm other land as well. There are other requirements under the Order and potential purchasers must take independant advice on this and the prior approvals in place on this property if they wish to erect the buildings.
Overage
Subject to an overage clause whereby 25% of any uplift in value due to the grant of permission for residential dwellings (i.e. the difference in value between the land without permission for residential use and then the value with permission for those uses) will be payable back to the vendors. The term of the clause will be 50 years.
Method of Sale
The land is being sold by informal tender with offers invited to be submitted by midday on Friday 11th February 2022. The vendors may be interested in renting back the fields from the purchasers. Please contact Fisher German for further instructions.
